DMCA & Copyright Policies

Sandbattle Studios, LTD (also referred to as "Sandbattle", "us", and "we") is committed to protecting the intellectual property rights of content owners while also providing a safe harbor for our users under the Digital Millennium Copyright Act ("DMCA"). This policy explains our procedures for handling notices of alleged copyright infringement and counter-notices. Since our forums and websites include user content and discussions, we evaluate all requests seriously.

1. Overview

Sandbattle respects the rights of copyright owners and expects its users to do the same. If you believe that any content on our websites, games, or other online services (collectively, the “Services”) infringes upon your copyrighted work, please follow the procedures outlined in this DMCA Policy.


2. Procedure for Copyright Infringement Notices

If you are the copyright owner or are authorized to act on the owner’s behalf, and you believe that your copyrighted work has been used on our Services without permission, you must provide us with a written DMCA Notice that includes:

  1. Signature: A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. Description of the Work: A description of the copyrighted work that you claim has been infringed.
  3. Location of Infringing Material: A description of the location on our Services (e.g., URL, game file, or other identifying information) where the infringing material is found.
  4. Contact Information: Your name, address, telephone number, and email address.
  5. Good-Faith Statement: A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright.

3. Counter-Notice Procedure

If you believe that material removed or disabled was removed due to mistake or misidentification, you may file a counter-notice with us. Your counter-notice must include:

  1. Signature: Your physical or electronic signature.
  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled, and the location where it appeared before removal.
  3. Statement of Good Faith: A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Contact Information: Your name, address, telephone number, and email address.
  5. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Sandbattle may be found) and that you will accept service of process from the party who filed the original DMCA Notice.

Upon receiving a valid counter-notice, Sandbattle will forward it to the party that filed the original notice. If that party does not file a lawsuit seeking a court order to prevent the reinstatement of the material within 14 business days, we will restore the material to our Services.

4. Repeat Infringer Policy

In accordance with the DMCA, Sandbattle reserves the right to terminate the accounts of users who are repeat infringers. Users who have been found to repeatedly infringe upon copyrighted works may have their access to our Services permanently terminated.

5. DMCA Safe Harbor

Sandbattle operates in compliance with the safe harbor provisions of the DMCA. We will not be held liable for infringing content posted by users, provided that we:

  • Remove or disable access to the infringing material upon obtaining a proper DMCA Notice.
  • Adopt and implement a policy for terminating repeat infringers.
  • Accommodate standard technical measures used by copyright owners to protect their works.

6. Policy Modifications

Sandbattle reserves the right to modify or update this DMCA Policy at any time without prior notice. The most current version of the DMCA Policy will be posted on our website. Continued use of our Services after any changes indicates your acceptance of the new terms.
